On Distributive Bargaining and Mediation - Essay Example Distributive bargaining is generally referred as negotiation of win and loses between parties where both the parties attempt to maximize their profit and minimize personal losses. On the other hand, integrative bargaining focuses on developing a win-win situation for both the parties. In certain specific situations, other measures of negotiation such as mediation are implemented as well. In this paper, mediation and distributive bargaining have been compared and analyzed as measures of negotiation. The paper also highlights benefits and drawbacks of both the measures in context of conflict resolution and discusses situations where each of these methods is most suitable. It was gathered that a number of scholarly articles on dispute resolution indicates that primarily two kinds of negotiation strategies are adopted in most cases, namely, distributive bargaining and integrative bargaining. The philosophy of distributive bargaining focuses on value claiming and refrains from dividing the pie. There has been a mention of pie in this paper as the concept is often compared to division of pie by most researchers. The distributive bargaining is implied in terms of zero sum approach of economic theory because the process of dividing outcomes of an event under this method of negotiation is mutually exhaustive (Amanatullah, Morris & Curhan, 2008). Color Theory Essay Wonder Woman hated men when she first set off to the world from her home, Themyscira, but later understood that she was wrong in her initial assessment of men because she simply didn’t understand men. In Deborah Tannen’s essay, â€Å"Sex, Lies, and Conversation†, the often misunderstood forms of communication between men and women are explored. Gloria Steinem, American feminist who is a nationally recognized leader of the women’s liberation movement in the 1960’s and 1970’s, who expressed how she felt Wonder Woman is an exemplary model of what a feminist is. I believe Steinem would agree with many of Tannen’s views because they are rational, based on research and her essay is meant to bring the two genders to better understand one another. Steinem and Tannen both have the same goal; they both strive to find peace between men and women. Tannen discusses extensively in her essay about how if you understand that both men and women are raised in separate cultures, American man culture and American woman culture. An example of this would be how women place intimacy as the foundation of relationships, and talking as the cornerstone of relationships. The bonds between men can be as intense as women’s relationships, but they are founded less on talk and more on the activities they experience together. Both forms of communication are used to build bonds between peers but do so in different ways, and that’s a pattern that follows both cultures throughout â€Å"Sex, Lies and Conversation†. I believe that Steinem would agree that to have peace between the two sexes, there must be some sort of understanding of how the two sexes communicate with one another. Through that understanding, women would live far bette r lives in a world that seems dominated by men. Throughout her essay, Deborah Tannen is clearly explaining that the problem between the sexes is that there is much mistranslation but that it is reparable and she even goes to state â€Å"Once the problem is understood,  improvement comes naturally†. Her essay is something Gloria Steinem would agree on and possibly even recommend to members of her various organizations to help improve their relationship with the world around them. Wonder Woman’s values like self-reliance, peacefulness and esteem for human life are all values that Steinem believes that feminists are trying to introduce into the mainstream. Although Steinem focuses heavily on improving the lives on women, I believe she does that because women are at a disadvantage in today’s society and she’s looking to help bring equality between the sexes. The gap that only a few years separated women from men in society having equal opportunities and rights is slowly disappearing and I think its in large part due to the efforts of people like both Steinem and Tannen. People who are looking to both understand that although men and women are different, they should to be allowed access to the same opportunities. Steinem’s efforts to empower women correlates with Tannen’s effort to bring to light the need of a cross-cultural understanding between men and women because in the end, they just want to see improvement in communication. It wouldn’t be much of a stretch to understand that Steinem would agree with Tannen’s attitude towards the failure of communication between the sexes. If people start to understand how to interpret how the two sexes communicate and educate themselves and others, The world would be a better place for everyone. Like Tannen says at the end of her essay, â€Å"like charity, successful cr oss-cultural communication should begin at home.†

Everyone Is Entitled To Their Own Opinion On December 10, 1948 the General Assembly of the United Nations proclaimed the Universal Declaration of Human Rights Following this significant act the Assembly called upon all Member countries to announce the text of the Declaration, read and expounded principally in schools and other educational institutions, without difference based on the political status of countries or territories. So the question, if everyone is entitled to their own opinion could find ease answer in the article 19, in which is stated that Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.(David Weissbrodt and Connie de la Vega , p102) This universal declaration of human right set a worldwide standard of achievement for all people and all nations, to the end that every human being and every organ of society, keeping this Declaration constantly in mind, and make every effort by teaching and encourage respect for these rights and freedoms , nationally and internationally, to secure their universal and effective recognition and observance, both among the people of Member States themselves and among the people of territory under their influence. Definitely the recognition of equal and inalienable rights of all members of the human family is the underpinning of freedom, peace and justice in the world. We can confirm that wherever, either in the past or in the present time or future there is the absence of such status we will always experience result of barbaric acts. Of course Senator Daniel Patrick Moynihan declaration Every man has a right to his own opinion, but no man has a right to be wrong in his facts., will change the opinion about opinions .So opinions can hold opposing views, but those opinions must be based on factual truths, and hold specific characteristics such as, prevent harm to others, avoid source of offence or be offensive and of course avoiding moral transgressions. (Tom Gorman, 2007 p.100-102) We can say that, dangerous opinions lead to dangerous actions or fact. And when they do, we need to stand up and strongly criticise those dangerous actions and be critical of the beliefs which lead to those actions. Now again, we are not talking about outlawing those dangerous opinions and beliefs, but we are talking about being critical of those opinions and beliefs. We could be supportive to the ACLU (American Civil Liberty Union) when they protected the KKK (Ku Klux Klan) for their right to march- demo peacefully. But if they wanted to march peacefully in our cities, maybe we would be on the sidelines being very critical of their beliefs and against those views. In our analysis however, no opinions should be above criticism. We believe in the marketplace of ideas and in that bazaar all opinions and beliefs are welcome and should be similarly open to criticism. We all, not only criticise other peoples opinions every day, but no one would argue that it was immoral to express opinion or to criticise them. No one has a difficulty criticising what Hitler did to the Jews. Nor do people have concern in criticising the KKK for their views, or that Tom Cruise is constantly criticised for his religious viewpoint and so for the majority of Christians, Jews and Muslims that usually are underlined with criticism for their opinion .Of course the moment anyone criticises opinion and beliefs, we will have attempt to over dramatise the criticism with claims of intolerance and/or hate. Insinuations are made that their free speech is being taken away; creating a big misunderstanding of what really is freedom of opinion. Then to avoid such misunderstanding we should analyse the ramification of the different aspect of opinion, to fully appreciate the importance of a word and knowledge and how we could make the best use out of it. We could start doing so by using a philosophical approach. Now if we think that Philosophy is the pursuit of wisdom, we know that opinion and supposition are inconsistent with logic. There is no hesitation in thinking, that philosophy provides the practice of scientific reasoning, and so the knowledge of things and their causes, through reason and dialogue. It is a way of comprehending what is factual and what is correct by focusing on rational understanding and analysis, or simply what makes sense. So once we establish this concept we can move on to the second approach, in which , principles travel the opposite way of the first approach ,but worthy to be taken under consideration .So we will look at the expression of opinion under intellectual point of view and, if it should be voiced freely by any individual . We can say that an Intelligent person whether his opinion is based on fact or not, will make the difference. Already, for someone to have his opinion makes the biggest difference. An educated person has an opinion on any matter; .and can give a plausible answer on any question. The reply does not have to be exact, or even precise, but an individual must have some opinion to discuss on the subject. Thus, it is not indispensable to know the facts in order to express an opinion; an opinion may even be entirely unsupported in an argument. So also examining the expression of opinion under academic view, we can confirm that any one is entitled to their own opinion, especially those individuals with a particular cultural preparation, since, we know that if an opinion is not founded on demonstrated and valid information, it is irrelevant. Of course we can argue that, on a certain extend, because if we do consider the examination of relativity of the opinion, we would find a different prospective. In the language of relativity, everyone is accurate. Possibly from their particular point of view, everyone is in the situation of believing that they have accurately determined the order of events. However, we know that it is not possible for everyone to be right. For example If everyone has a diverse opinion about which is the best classical painter of all time in the world it may not be possible to determine finally who is correct, and so we may be tempted to say that they are both entitled to their opinion or point of view. So entitled or not, the best painter is by designation only one , and the opinions of all but one admirer are wrong, even though its not possible to say whose opinion is correct .At this point it will be important to examine the understanding of true in believing the opinion. Everyone should have the independence to seize their own beliefs and the freedom to attempt convincing others of the truth of those beliefs and opinions. But as we know, not all beliefs can in fact be equally true. If you believe that a painting completed by Mr Jones is superior than the one done by Michelangelo, or that someone says that the summer in Egypt is warmer than the one in Italy and we believe it is wrongly the way around , we could both be wrong , but we can not both be right. If we believe the Mount Etna is an Active volcano, and you believe that it is not, we can not both be right. When it comes to the difference between an active volcano or not, we can not say everyone is entitled to their own opinion. Moderately, we look at the proofs and facts, and try to outline whose opinion is really right. Clearly before expressing opinion we should examine the possible evidence, and not dismiss the case without even looking at it. So it is important before believing in particular opinion the examination of evidence. So, trying to understand, how we could become different from the kind of person who would ignore the evidence, and still believe in his own opinion. And in doing so we may encounter the examination of the probable opinion, philosophically well illustrated by Bertrand Russell: What we strongly believe, if it is true, is called knowledge, provide d it is either intuitive or indirect (logically or psychologically) an intuitive knowledge from which it follows logically. What we firmly believe, if it is not true, is called error. What we firmly believe, if it is neither knowledge nor error, and also what we believe undecided, because it is, or is derived from, something which has not the main extent of self-evidence, may be called probable opinion. Thus the larger part of what would regularly pass as knowledge is more or less probable opinion. A body of individually probable opinions, if they are mutually rational, become more probable than any one of them would be individually. It is in this way that many scientific hypotheses obtain their probability. They fit into a coherent system of probable opinions, and thus become more probable than they would be in isolation. The same thing applies to general philosophical hypotheses. Often in a single case such hypotheses may appear extremely doubtful, while yet, when we consider the order and coherence which they introduce into a mass of probable opinion, they turn into almost certain. The answer is that it is up to each individual to choose whether voicing their opinion on a topic, is valuable or not. We know that voicing opinion in certain circumstances may lead to dreadful consequences and if we would do so, we should be prepared to deal with those consequences.

European Commission’s Proposal on Software Patents The European Commission should maintain and clarify its limitations on patents for software, to fight against American mega companies attempting to globally monopolize software, to avoid the mistakes the United States has made, and to potentially let Europe emerge as a software mecca, where software can continue to make significant advancements. This viewpoint can be supported with several ethical considerations, including Ethical Egoism, Utilitarianism, and Pluralism. General View on Software Patents Purpose of a Patent Patents have a dual role in our society. An invention or new creation should be shared with the public and peers to enrich the public body of technical knowledge. In return, society rewards inventors for their efforts by giving a monopolistic control over the invention. In general, patents cover a practical implementation of an idea, as in a product, and not the idea itself. The patent system is in place to promote innovation. Patents on Software Merriam-Webster defines software as, â€Å"something used or associated with and usually contrasted with hardware: as: the entire set of programs, procedures, and related documentation associated with a system and especially a computer system; specifically : computer programs.†[1] Britannica Encyclopedia defines software as, â€Å"instructions that tell a computer what to do.†[2] These definitions of software as a set of instructions, or an associated part with hardware, immediately differentiate it from your typical invented product. By itself you do not have a product, yet United States case law has contended that once you put that software on a disc, you do have a product. Patents have been crucial to distributing your typical technical innovation. Software has no such limitation. Software ideas and innovations have spread quickly through the public domain of information. Some reasons for software distributing so quickly is its relative immaturity as a science and engineering practice, extensive freely distribution from universities, and a near direct fiscal value in general acceptance and use of a software concept[3]. Software innovation has flourished under the general availability of software code, concepts, and tools. Additionally, software is developed incrementally, building quickly on existing concepts. In general, the patent system has been shown to slow the development of incrementally developing technologies such as software[4]. A Modest Proposal: The Environment Essay -- essays research papers

Something akin to panic is communicated onto my sterile computer screen, then my furrowed brow and soon my troubled mind when I sit alone, in the dark of my room and explore ideas and possibilities. Turning the light on and the computer off doesn’t dissolve my disturbed mood; nothing does until the outside can creep in and warm me. It’s usually a human voice; something more real than the essays and articles I read on global warming and remote ice caps that melt slowly every year. The fear settles until someone with a weaker sense of reality can convince me that â€Å"something is being done† by environmental scientists and none of it will affect me when I am dust. In just the last fifty years, humans, namely Americans have virtually remodeled the Earth and everything on it. We have changed its landscapes, wind patterns, migration routes, and weather; diminished its greenery and killed its animals. Nature did not seem a force that could be controlled and yet it has been. We are conducting an inadvertent global experiment by changing the face of the entire planet. We are destroying the ozone layer, which allows life to exist on the Earth's surface, clearing the majority of the earth’s forests, and disrupting countless ecosystems. The result has been an unfavorable alteration of the composition of the biosphere and the Earth's heat balance. If we do not slow down our use of fossil fuels and stop destroying the forests, the world will become hotter than it has been in the past million years. This warming will rearrange entire biological communities and cause many species to become extinct. The desperate plight of the environment should by all means be the first priority for every single government and person on this planet. With today’s common knowledge of what might happen in the near future if significant changes aren’t made in the lifestyle of most people it’s hard to understand why 70 million cars continue to vomit their poison into the air everyday. All around the world environmental activists fight to preserve our patches of rain forests and wetlands, as well as protect a variety of fragile but important ecosystems. In all major cities, advocates of environmental conservation annually propose plans with alternative modes of transportation and energy-efficient appliances that will every citizen would be mandated to use. Even if instituted gradually, these ch... ...r. â€Å"Environmental Studies† were the most interesting and abstract words I had ever seen preceding â€Å"High School†. For this reason and the fact that it was near Central Park, I decided to apply and then attend. Because of the central theme of my classes I have been exposed in the shape of special speakers and class discussions to others who share my fear but not my growing sense of hopelessness. Quite recently, it has become more and more important to me that I am a part of the solution for the problems facing the environment. It is fear that I feel when I allow myself to dwell on the ignored warnings and the very complicated mess of problems and impossibilities that plague this planet. I don’t understand why there is even the possibility that one of the last natural, pristine ecosystem, in North America, namely that of Alaska, is in danger of being ruptured by the ever-powerful oil companies. I don’t understand why the heads of state who are infinite ly more knowledgeable than me on the dangers of continued abuse of our gracious home don’t drastically and immediately cause change. I don’t understand why people haven’t listened. I guess it’s because they are not fifteen and scared.

There are too many risk; abortions can cause young women infertility, meaning they will not be able to have kids. Young women young women have to deal with extreme fetal pain during an abortion process; there is also the probability that some can die right there on the table and have drastic changes in there hormones. Studies have proven that abortions can lead to an increased chance of breast cancer, Pelvic Inflammatory disease, and the contraction of Viral Hepatitis due to excessive bleeding and complications. We as teenagers also need to learn to grow up and take care of our responsibities Teen abortions is legal in almost every state, although some require parental or guardian permission. Abortion is the prevention of an innocent life, which is allowed without permission in over 20 states. I feel that teenage abortions should be banned from all stats even the ones with parent permission because sometimes a parent can force a child to have an abortion. Many women do not see a problem with abortion because according to them, a fetus is just cells. A fetus is more than just cells, it is a human being. Eighteen days after conception, doctors have detected the unborn child’s beating heart. Forty-five days after conception, brain waves have been detected. By three months, all body systems are present and functioning. All of these things occur in the first trimester and ninety-five percent of abortions are performed during the first trimester. What would you do if you accidentally got a young female pregnant, would you handle your responsibilities, or would you take the easy way out and get the abortion? Each and everyday teenagers all over the world are making the decision of taking the easy way out. Now days the way to bail out of having a child is to get an abortion. then you’ll never have to worry about diapers, and milk. When you handle your responsibilities you get the enjoyment of raising you own and being there for a younger one that will look up to you for the rest of there life. As a teenagers having an abortion can impact your life forever whether you decide to abort or give birth. Most teenagers find them selves in a hard position when a child is on its way of being born. eenagers begin to panic and think of all the things that they will miss out on in life, because of a child being born. Your friends and peers around you will either support you or start to dislike you in terms of your decision to get rid of a living fetus. Once any teenager its not like it can be undone the baby is already dead. All teenagers should take there time and really think about it before they go and get this process done. Abortions can cause young girls to have infertility in there futures. Whether you choose to keep your baby, put the baby up for adoption or have an abortion, hormones run crazy when you are pregnant. As you feel the life inside you start to grow, you become attached to it, or perhaps even angry with this new life. Sometimes teens even try to kill themselves because they don’t want to go though the abortion process. Some parents force teenagers to get abortions so that it doesn’t look bad on them and ruin their daughters lives. Responsibility is a big thing in raising a child without responsibility you find your self wanting to take the unborn life away. The issue of abortion has divided the country. However, there is an issue that we can all come to agree and that is a genuine reluctance of our society to take responsibility. The truth is that the majority of abortions do not occur because of the raping of a woman, incest, or potential loss of the mother's life. So why do they occur so often? They occur because people realize that they do not want to have a child for a number of different reasons from an inability to afford one to the potential change it causes to the female body. Nonetheless, the decision is not made because of the fear of the mother losing her life or any of the predominant explanations for the occurrence of abortions. At the root of the occurrence of so many abortions is the inability of individuals in society to take responsibility for their actions. Bearing children is the natural result of sexual intercourse under favorable conditions, it is not forced upon women by the United States government. I am forced to wonder: If a woman has a history of bad decisions which cause her an unwanted pregnancy, why should our society trust her to take the welfare of the child into account and trust her not make the abortion decision? Still, though it is clear that women have made choices that put them in the position of being pregnant, it is worthwhile to repeat a few reasons why abortion is an abhorrent murder of a baby. When a teenager gets pregnant there young bodies open up to a lot of diseases. They can contract Pelvic Inflammatory Disease, and the contraction of Viral Hepatitis due to excessive bleeding and complications. There is a possibility that teenagers can die on the table or to have drastic fetal pain. During the abortion process teenagers will feel excessive cramping as the excess blood discharges from the body. Teenagers may also contract Bacterial vaginosis which is one of the most common vaginal infections that occur in women today in the United States. Also a teenager can mess up her body by getting abortion that she can have a handicapped newborn in later on wanted pregnancies. Abortion is associated with cervical and uterine damage which may increase the risk of premature delivery, complications of labor and abnormal development of the placenta in later pregnancies. Complications are the leading causes of handicaps among newborns. Compared to women who abort teenagers who abort are two to four times more like to commit suicide. Teens are more likely to have psychological and relationship problems. Studies have shown that the major factors in pregnancy decision making among teens are the attitude of the teens parents, the baby’s father, and friends; the personality of the girl herself. A young girls mind can be messed up, this physical effect may cause her to feel an emotional emptiness she have never felt before. Less frequent side effects include possible heavy or prolong bleeding, blood clots, damage to the cervix and the uterus. Infection due to retain products of conception or infection caused by an STD or bacteria being introduced to the uterus can cause fever, pain. Abdominal tenderness and possibly scared tissue. All extreme things that you can die from. Teen abortion kills an innocent life. You exist because your mother chose to give birth to you. Personally I believe abortion is wrong and is definitely not a decision a teenager should have to make at all. Abortions should be band from society because we all need to grow up and take care of our responsibilities. Yea you might get pregnant, and you might not be ready but that doesn’t give you the right to kill an innocent life. Just think God has sent you down a soon to be beautiful baby, there are a lot of people that are unfortunate and have to adopt. Whether it is physical harm to the body or the religious point of view, there are two many risk with abortions in general.
